RE: DEMAND TO CORRECT REPORTED BALANCE TO $0 ON SOLD ACCOUNT #[ACCOUNT ACCOUNT NUMBER MASKED]
Dear Credit Operations Department,
I am writing regarding Account #[ACCOUNT ACCOUNT NUMBER MASKED] with [ACCOUNT CREDITOR NAME]. According to credit reporting records, this account was charged off and subsequently sold or assigned to a third-party debt buyer.
However, [ACCOUNT CREDITOR NAME] continues to report a non-zero balance of [ACCOUNT BALANCE] on my credit files.
LEGAL REQUIREMENTS & METRO 2 GUIDELINES:
Under 15 U.S.C. § 1681s-2, Metro 2 credit reporting standards, and CFPB Consumer Financial Protection Circular 2022-07, once an original creditor sells or transfers a debt portfolio to an independent debt buyer, the original creditor MUST report:
1. Account Status Code: Sold/Transferred;
2. Current Balance: $0; and
3. Amount Past Due: $0.
Reporting a balance after transferring ownership is inaccurate because [ACCOUNT CREDITOR NAME] no longer owns the account or possesses any legal right to collect payment. Double reporting of balances by both original creditor and debt buyer artificially inflates consumer debt liability in violation of FCRA accuracy mandates.
I demand that you update Account #[ACCOUNT ACCOUNT NUMBER MASKED] to reflect a $0 balance and $0 past due immediately.
Sincerely,
[CLIENT FULL NAME]
