RE: DEMAND FOR IMMEDIATE PERMANENT DELETION — Illegal Reinsertion Violation Under FCRA 15 U.S.C. § 1681i(a)(5)(B)
To Whom It May Concern at [BUREAU NAME],
I am writing to demand the immediate permanent deletion of an item that was illegally reinserted into my consumer credit file in direct violation of federal law.
On [PRIOR LETTER RESPONSE DATE], [BUREAU NAME] formally notified me in writing that the following item was deleted from my file:
Creditor / Account Name: [ACCOUNT CREDITOR NAME]
Account Number: [ACCOUNT ACCOUNT NUMBER MASKED]
However, a recent inspection of my credit file reveals that this item has been reinserted.
Under FCRA § 611(a)(5)(B) (15 U.S.C. § 1681i(a)(5)(B)), a consumer reporting agency MAY NOT reinsert previously deleted information unless:
1. The furnisher certifies that the information is complete and accurate.
2. The CRA notifies the consumer in writing of the reinsertion within 5 business days of the reinsertion (§ 1681i(a)(5)(B)(ii)).
[BUREAU NAME] failed to provide the mandatory 5-day written notice of reinsertion. Under § 1681i(a)(5)(B)(i), you must immediately and permanently purge this item from my file.
Sincerely,
