RE: Formal Dispute — Unlawful Re-Aging of Date of First Delinquency Pursuant to 15 U.S.C. § 1681c(c) & § 1681s-2(a)(5)
To Whom It May Concern at [BUREAU NAME],
I am writing to formally dispute the illegal re-aging of the Date of First Delinquency (DOFD) on an account listed on my credit report. Under 15 U.S.C. § 1681c(c) and 15 U.S.C. § 1681s-2(a)(5), the statutory 7-year reporting window is permanently fixed to the initial delinquency date on the original account.
The re-aged entry is listed as follows:
Collection Entity / Creditor: [ACCOUNT CREDITOR NAME]
Account Number: [ACCOUNT ACCOUNT NUMBER MASKED]
Reported / Altered DOFD: [ACCOUNT DATE OF FIRST DELINQUENCY]
Dispute Details: [ACCOUNT DISPUTE REASON]
Corrective Action Demanded: [ACCOUNT CORRECT INFORMATION]
A debt collector or successor debt buyer cannot alter, advance, or restart the DOFD upon acquiring an account. Artificially resetting the DOFD to bypass FCRA § 605 obsolescence constitutes willful noncompliance.
Please conduct an immediate reinvestigation with the original creditor's historical records. Correct the DOFD to its original date or delete the obsolete entry within 30 days under 15 U.S.C. § 1681i(a)(5)(A).
Sincerely,
____________________________________
