RE: FORMAL DEMAND TO IMMEDIATELY MARK ACCOUNT AS DISPUTED IN CREDIT REPORTING (15 U.S.C. § 1692e(8))

Dear [RECIPIENT NAME],
I am writing regarding your credit reporting of the above-referenced account on my credit reports (Equifax, Experian, TransUnion).
Please be advised that I formally disputed this debt with your agency on [PRIOR LETTER DATE] via written notice (Certified Mail # [PRIOR LETTER CERTIFIED NUMBER]). However, a recent review of my credit reports indicates that your agency continues to furnish information regarding this debt WITHOUT indicating that the account is disputed by the consumer.
Under 15 U.S.C. § 1692e(8), it is an explicit statutory violation of the Fair Debt Collection Practices Act to communicate to any person credit information which is known or which should be known to be false, "including the failure to communicate that a disputed debt is disputed."
Additionally, under FCRA 15 U.S.C. § 1681s-2(a)(3), a furnisher who receives notice of a dispute from a consumer SHALL NOT furnish information to any CRA without including notice that the information is disputed.
Because your agency was aware of my dispute prior to transmitting credit updates, your failure to report the account as "Disputed by Consumer" constitutes a willful violation of 15 U.S.C. § 1692e(8).
I demand that you IMMEDIATELY notify Equifax, Experian, and TransUnion to update the trade line status to "Disputed by Consumer". Provide written confirmation to me within fifteen (15) days that this dispute marker has been transmitted.
Sincerely,
[CLIENT FULL NAME]
