RE: MANDATORY CORRECTION OF POST-BANKRUPTCY CREDIT REPORTING - Account #[ACCOUNT ACCOUNT NUMBER MASKED]
Dear Bankruptcy Compliance Department,
I am writing to demand an immediate credit reporting correction regarding account #[ACCOUNT ACCOUNT NUMBER MASKED] with [ACCOUNT CREDITOR NAME].
BANKRUPTCY DISCHARGE INFORMATION:
- Account Name: [ACCOUNT CREDITOR NAME]
- Account Number: [ACCOUNT ACCOUNT NUMBER MASKED]
- Case Number: [BANKRUPTCY CASE NUMBER]
- Bankruptcy Court: [BANKRUPTCY COURT]
- Chapter: [BANKRUPTCY CHAPTER]
- Discharge Date: [BANKRUPTCY DISCHARGE DATE]
CURRENT ILLEGAL REPORTING:
Your company continues to report a non-zero balance of [ACCOUNT BALANCE], an amount past due, or an active delinquency status.
LEGAL OBLIGATIONS (11 U.S.C. § 524 & 15 U.S.C. § 1681s-2):
Under 11 U.S.C. § 524(a)(2), a discharge operates as an injunction against any act to collect, recover, or offset any discharged debt. Furthermore, official FTC and CFPB credit reporting guidelines confirm that reporting a balance or past-due amount on a discharged debt is false and misleading under the FCRA.
The account MUST be updated across all credit reporting agencies to reflect:
1. Account Status: Included in Bankruptcy / Discharged;
2. Balance: $0; and
3. Amount Past Due: $0.
Please correct this reporting immediately and notify Equifax, Experian, and TransUnion.
Sincerely,
[CLIENT FULL NAME]
